2) Additional Rules/Terms for Competitions

The website may at times post information about competitions and other features that are each governed by additional rules. Please read those rules, posted or linked at each feature, before participating in them, as they form part of these terms to which you agree through your continued use of this site.

3) Access to tramppress.com

i) Tramp Press will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However uninterrupted availability of the website cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We shall make all reasonable efforts to minimise any periods during which the website is not available. You accept that you will have no claim for breach of contract or otherwise in respect of any such period of unavailability.

ii) Neither Tramp Press, nor our affiliates, agents, or licensees, make any representation that materials on the websites are appropriate or available for use in locations outside the Republic of Ireland, and accessing them from territories where their contents are illegal or prohibited. Those who choose to access the websites from other locations do so under their own initiative and are responsible for compliance with local laws.

iii) We further do not warrant that the websites or the products and materials contained on such website are error free, or that errors will be corrected, or that this site or the server from which it is run is free of viruses or other potentially harmful codes.

4) Intellectual Property

i) All content included on the website, such as text, graphics, logos, button icons, images, is owned, or licensed by, Tramp Press Ltd and is protected by international copyright and database right laws. You may not copy, reproduce, upload, post, distribute, republish, retransmit, display, or modify, in any way, any of the material on this site, including computer code and software, except in the limited circumstances outlined below in Section 4.iii.

iii) Permission is granted to electronically copy and print hard copy portions of this site for the sole purpose of placing an order with Tramp Press, or purchasing Tramp Press products. You may also display, and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the site solely for your own non-commercial, private use, subject to you agreeing not to change or delete any proprietary notices from materials downloaded or copied from the site. Licence or permission must be obtained for any use, in any format, of any tramppress.com owned or licensed content or materials not listed here.

5) Your Conduct

i) You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way.

ii) You understand that you, and not Tramp Press, are responsible for all electronic communications and content sent from your computer to us and you must use the website for lawful purposes only. You must not use the website for the following:

– fraudulent purposes, or in connection with a criminal offence or other unlawful activity;

– to send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing; or in breach of copyright, trademark, confidence, privacy or any other right; or is otherwise injurious to third parties; or objectionable; or which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any “spam”

6) Orders, Sales, and Delivery

i) When you place an order to purchase a product from Tramp Press, we will send you an email confirming receipt of your order and containing the details of your order, if you have provided us with your valid email address. Your order represents an offer to us to purchase a product, which is only accepted by us when we send email confirmation to you that we’ve dispatched that product to you.

ii) When you visit tramppress.com or send emails to us, or place an order(s) to purchase a product, you are communicating with us electronically. As we communicate with you by email or by posting notices on the website, for contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

iii) All prices for the products are inclusive of taxes but exclusive of delivery charges.

iv) All product prices and delivery charges are shown in Euro. If necessary, your payment card company will perform any currency conversion.

v) The price of an item is the price on the day of your order. We try to ensure that all prices on display on the websites are accurate but the price on your order will need to be validated by us prior to processing your order. Where a Product’s correct price is higher than the price stated on your order we will contact you to let you know the correct price and give you the opportunity of reconfirming your order or cancelling before we dispatch the Products.

vi) In the event that a Tramp Press product is mistakenly listed at an incorrect price, Tramp Press reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Tramp Press Ltd reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Tramp Press shall issue a credit to your credit card account in the amount of the incorrect price.

vii) All Products are subject to availability. Where stock has run out or cannot for some reason be dispatched, we will contact you by email to inform you of this and give you a likely delivery date for within 14 days. If it is not possible to deliver within 14 days, we will not accept that part of your order.

viii) All delivery times are estimates only and, while we will endeavour to avoid delay, we will not be liable to you for any loss or damage arising from delay in delivery.

ix) We may deliver your order by installments. Delivery charges will be those set out at the time you placed your order.

x) If you receive the wrong Goods or Goods are damaged in transit, you must contact us within 28 calendar days of the date of sale and provide details of your complaint. All reasonable attempts will be made to reimburse or provide a replacement subject to availability of stock and our assessment of the claim. This does not affect your statutory rights.

xi) When ordering Goods from tramppress.com for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office or post office for further information. Additionally, please note that, when ordering from tramppress.com, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the Goods.

xii) There may be a territorial restriction on our ability to deliver products and we will inform you accordingly. It is your responsibility to provide us with a full and accurate delivery address (including country).

xiii) If we are unable to perform the whole or part of these Sales Terms due to any cause or event beyond our reasonable control we may, at our option, by notice in writing to you, cancel or suspend these Sales Terms in whole or in part without liability and without prejudice to our rights to receive payment of the price for all Goods previously delivered.

xiv) If for any reason you are unhappy with your purchase, you can return it to us in its original condition within 14 days of the date you received the item. You are also entitled to a statutory cooling-off period of seven business days. When we have received the returned items in good condition, we will refund you in full.

7) Liability

Tramp Press shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the Products, even if Tramp Press has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

8) Representations and Warranties

Our employees and agents are not authorised to make any representations or give any warranty concerning the products unless these are confirmed in writing by us. You acknowledge that you do not rely on, and waive any claim for any breach of any representation or warranty which is not so confirmed.

9) Indemnification

You agree to indemnify, defend, and hold harmless Tramp Press, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your internet account.

10) Defamation

Tramp Press operates on a “notice and takedown” basis. If you believe that any content on, or advertised for sale on, the website contains a defamatory statement, please notify us immediately. Once this procedure has been followed, Tramp Press Ltd will make all reasonable endeavours to remove the defamatory content complained about within a reasonable period of time.

11) Intellectual Property

Tramp Press and its affiliates respect the intellectual property of others. If you believe that your intellectual property rights have been used in a way that gives rise to concerns of infringement, please notify us immediately.

12) Termination

These terms may be terminated by us at any time without notice. In this event of termination, you are no longer authorised to have access to the site and all limitations on our liability and on your use of our material shall survive. These Terms, along with the Sales Terms and any additional rules or conditions referred to herein and the Privacy Policy constitute the entire agreements and understanding between you and us as to your use of the websites superseding all prior or contemporaneous communications and/or proposals.
